3. Account Registration

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you are at least 18 years of age.

4. Smart Bottle Use

CloudSip bottles are designed to monitor hydration and beverage temperature. While we strive to provide accurate information, our products are not medical devices and should not be used to diagnose, treat, cure, or prevent any disease or health condition.

4.1 Product Care

To ensure optimal performance and longevity of your CloudSip bottle, please follow all care and maintenance instructions provided in your product manual. Improper use or care may void your warranty.

4.2 Data Collection

Our smart bottles collect data about your hydration patterns and beverage temperature. This data is processed in accordance with our Privacy Policy.

5. Intellectual Property

All content on our website, mobile applications, and related to our products, including text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of CloudSip or its content suppliers and is protected by Australian and international copyright laws.

Our trademarks and trade dress may not be used in connection with any product or service that is not CloudSip's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits CloudSip.

6. User Content

When you submit, upload, or post content to our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your content in any existing or future media.

You represent and warrant that you own or have the necessary rights to the content you submit and that your content does not violate the rights of any third party, including intellectual property rights and privacy rights.

6.1 Prohibited Content

You may not post content that is illegal, fraudulent, deceptive, misleading, defamatory, obscene, or otherwise objectionable. We reserve the right to remove any content that violates these Terms or that we find objectionable for any reason.

7. Limitation of Liability

To the maximum extent permitted by law, CloudSip and its affiliates, officers, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

In no event shall CloudSip's total liability to you for all damages, losses, and causes of action exceed the amount paid by you to CloudSip for the Services in the last six (6) months, or AUD $100, whichever is greater.

8. Indemnification

You agree to indemnify, defend, and hold harmless CloudSip and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within New South Wales, Australia.

10. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us for account deletion.

11. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. CloudSip expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

CloudSip makes no warranty that the Services will meet your requirements, be available on an uninterrupted, secure, or error-free basis, or that defects will be corrected.
